1. Sponsor: Madison Square Garden, L.P. (“MSG”)
2. Sweepstakes Period: The 2009 O.A.R. at MSG Sweepstakes (the “Sweepstakes”) begins at 12:00pm (noon) Eastern Time (“ET”) on Tuesday, June 2, 2009 and ends at 11:59PM ET on Wednesday, August 5, 2009 (the “Sweepstakes Period”).
3. Eligibility:
Sweepstakes is open to legal US residents, 21 years of age or older at the time
of entry. Sweepstakes is void where prohibited
or restricted by law. Employees and
directors of MSG, its parent corporations, affiliates, subsidiaries, dealers,
advertising and promotion agencies and the immediate family members and persons
living in the same households of the above are ineligible. The term
"immediate family" shall mean spouses, parents, siblings, children,
grandparents and grandchildren.
4. How to Enter: Go to www.msg.com/oar, follow the “O.A.R. at MSG Sweepstakes” links and submit your full name, complete mailing address, date of birth, daytime and evening phone numbers and email address. Limit one (1) entry per person. If more than one entry is submitted by any person, only the first entry received will be eligible. Facsimiles and/or mechanical reproductions of entries are not eligible. Sponsor is not responsible for late, lost, stolen, illegible, incomplete, postage due, misdirected entries or mail, or for typographical or other errors in the printing of this offer, administration of the Sweepstakes or the announcement of prize.
5. Prize:
One (1) Grand Prize winner will receive: (i) two (2) tickets to the O.A.R.
concert at Madison Square Garden on August 15, 2009, (ii) two (2) entry passes,
including complimentary refreshments, to the band’s VIP lounge during the
concert, (iii) a meet and greet opportunity with O.A.R. before or after the concert, subject to their availability, and (iv) two (2) autographed copies of O.A.R,’s “All Sides” CD. Approximate Retail Value of Grand Prize package: $450.
6. Winner Selection: On or about August 6, 2009, Sponsor will select one (1) Grand Prize winner in a random drawing from among all eligible entries received. The Grand Prize winner will be notified by e-mail and/or telephone on or about August 6, 2009. If the winner is unreachable, or does not make direct contact with Sponsor by the date specified in the notification, or fails to accept the prize, such winner will forfeit the prize in its entirety and an alternate winner will be selected in a random drawing from the remaining eligible entries. Odds of winning depend upon the number of eligible entries received. Sponsor’s decisions on the selection of the winner and all matters relating to this Sweepstakes shall be final.
7. Prize
Conditions: The winner is solely responsible for
any costs and expenses not expressly described as part of the prize. All federal, state and other tax liabilities
will be the sole responsibility of the winner.
Prize cannot be transferred, substituted, assigned, or redeemed for
cash, except at Sponsor’s sole discretion.
In the event of unavailability, Sponsor, in its sole discretion, may
substitute the prize or any portion thereof for one of equal or greater value. Winner may be required to execute and return,
within the time period specified during notification, an Affidavit of
Eligibility and Waiver/Release (which will be sent to the selected winners on
or about the date the selected winner is notified) or an alternate winner may
be selected. If the foregoing documents are not completed, signed, and returned
within the stated time, if the winner is found to be ineligible, or if the winner
does not comply with these Official Rules, then such winner will be
disqualified and an alternate winner may be selected by Sponsor in a random
drawing from among the remaining eligible entries. By accepting the prize, the winner
consents to being interviewed on camera (live or taped) by Sponsor (the
“Interviews”). Except where prohibited
by law, the winner's acceptance of the prize constitutes agreement for Sponsor to
use the winner's name, photographs, video, likeness, statements (if true), Interviews,
biographical information, voice, and city and state of residence for
advertising and trade purposes on a worldwide basis (without review by winner)
and in all forms of media, including on the MSG Network, without further
compensation, remuneration, or authorization.
8. Sweepstakes Conditions: This Sweepstakes is subject to all applicable federal, state and local laws. By participating, entrants waive any right to claim ambiguity in the Sweepstakes or these Official Rules. By providing your e-mail address you consent to being contacted by e-mail by Sponsor and its affiliated companies. ENTRANTS RELEASE, DISCHARGE, AND AGREE TO INDEMNIFY AND HOLD HARMLESS, Madison Square Garden, L.P. AND ITS RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, PARENTS, SUBSIDIARIES, AFFILIATES, AGENTS AND REPRESENTATIVES FROM AND AGAINST ANY LIABILITY FOR ANY DAMAGES, INJURY OR LOSSES (INCLUDING DEATH) TO ANY PERSON, OR PROPERTY, OF ANY KIND RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY FROM ACCEPTANCE, POSSESSION, MISUSE OR USE OF ANY PRIZE OR PARTICIPATION IN ANY SWEEPSTAKES RELATED ACTIVITY OR PARTICIPATION IN THIS SWEEPSTAKES.
9. Limitations of
Liability: Sponsor is not responsible
for incorrect or inaccurate capture of entry information, technical
malfunctions, omission, interruption, deletion, defect, or failures or
unavailability of any cable, telephone or computer line or network, computer
equipment, software or any combination thereof, or for late, lost, garbled, damaged,
misdirected, incomplete, illegible, undeliverable, destroyed or postage due
mail or entries. Sponsor may prohibit an
entrant from participating in the Sweepstakes or winning a prize if, in its sole
discretion, Sponsor determines that said entrant is attempting to undermine the
legitimate operation of the Sweepstakes by cheating, hacking, deception, or
other unfair playing or intending to annoy, abuse, threaten or harass any other
entrants or Sponsor’s representatives or employees. If for any reason this Sweepstakes is not
capable of running as planned, including but not limited to by reason of
tampering, unauthorized intervention, fraud, or any other causes beyond the
control of Sponsor which, in the sole opinion of Sponsor, corrupt or affect the
administration, security, fairness, integrity or proper conduct of the
promotion, then Sponsor reserves the right in its sole discretion to cancel,
terminate, modify or suspend this Sweepstakes and select the winner from among
the entries received prior to the action taken.
11. Claims/Choice of Law: (a) Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred in connection with this Sweepstakes but in no event attorneys fees; and (b) under no circumstances will an entrant be permitted to obtain awards for, and entrants hereby waive all rights to claim punitive, incidental and consequential damages and any other damages, other than actual out-of-pocket expenses, and any and hereby waives all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of New York, without regard for conflicts of law doctrine, and all proceedings shall take place in that State. All participants who enter the Sweepstakes agree to submit to the exclusive jurisdiction of the courts of the State of New York and agree to waive the right to a jury trial with respect to any claim or dispute with regard to any aspect of the Sweepstakes or Official Rules.
12. Winners List: For the name of the winner, send a self addressed stamped envelope to Madison Square Garden, Attn: MSG Network/O.A.R. at MSG Sweepstakes, Two Pennsylvania Plaza, 16th Floor, New York, NY 10121 by February 5, 2010.
