Stage the Engage with Ben Rector Contest (the “Contest”)

NO PURCHASE NECESSARY TO ENTER OR WIN. 

ELIGIBILITY: OPEN ONLY TO LEGAL US RESIDENTS RESIDING IN THE CONTINENTAL US WHO ARE 21 YEARS OF AGE OR OLDER WITH A SIGNIFICANT OTHER WHO IS ALSO 21 YEARS OF AGE OR OLDER. VOID OUTSIDE STATED AREA AND WHERE PROHIBITED. Employees, temporary workers, freelancers and independent contractors, and each of the foregoing’s immediate family members (spouse, parents, children, siblings and their respective spouses, regardless of where they reside) and those persons living in their same households, whether or not related, of MSG National Properties, LLC (“Sponsor”), Jewelers Mutual Insurance Company, SI (“JMIC”), and their respective parents, affiliates, subsidiaries, licensees, sponsors, promotional partners, prize suppliers, and advertising and promotion agencies are not eligible to enter or win.  By participating, entrants agree to be bound by these official rules (“Official Rules”) and the decisions of Sponsor, which are binding and final on matters relating to this Contest.  Contest is subject to all applicable federal, state and local laws.

CONTEST PERIOD: Contest begins at 12:00 AM Eastern Time (“ET”) on July 14, 2021 and ends at 11:59 PM ET on August 11, 2021 (“Contest Period”).

HOW TO ENTER: During the Contest Period, visit radiocity.com/stage-the-engage and follow the directions to complete and submit the entry form, including providing (i) honest responses to all of the listed questions and (ii) a photo of you and your significant other (“Significant Other”) only that is representative of your relationship (collectively, “Entry”). Photo must be submitted in .jpg, .png, .gif or .tiff format and can be no larger than 5 MB. All entries must be received by 11:59 PM ET on August 11, 2021 to be eligible. Limit one (1) Entry per person/email address. If more than one (1) Entry is received from any person or email address, only the first Entry will be considered, and all subsequent Entries will be void.  Incomplete Entries, and/or Entries generated by script, macro or other automated or mechanical means or by any means which subvert the entry process will also be void.  All Entries become the property of Sponsor and will not be acknowledged or returned.

PROHIBITED CONTENT:  Entries may not contain, as determined by Sponsor, in its sole discretion, any content that:

  • is sexually explicit or suggestive;
  • is violent or derogatory of any ethnic, racial, gender, religious, professional or age group;
  • is profane or pornographic;
  • promotes alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing), or otherwise promotes any activities that may appear unsafe or dangerous;
  • promotes any particular political agenda or message;
  • is obscene or offensive, or endorses any form of hate or hate group;
  • defames, misrepresents or contains disparaging remarks about Ben Rector, JMIC, Sponsor and/or its venues, products or services, and/or any other people or companies;
  • contains copyrighted materials owned by others used without the entrant having obtained permission, to the extent permission is necessary;
  • appears to duplicate any other submitted Entry;
  • contains materials embodying the names, likenesses, voices, personally identifiable information or other indicia of any person (living or dead) used without permission, to the extent permission is necessary; and/or
  • violates any law.

Entry must be entrant’s own work product, may not have been previously published, may not have won or been used to win previous awards or promotions, and must not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity.

By submitting an Entry, each entrant represents and warrants that their Entry conforms to these Official Rules and understands that Sponsor may disqualify the Entry for any reason, including if it determines the Entry fails to conform to these Official Rules in any way or otherwise contains unacceptable content.

USE OF ENTRIES/PUBLICITY GRANT: By submitting an Entry, each entrant hereby grants to Sponsor, its designees, successors, assigns and licensees a nonexclusive license to reproduce, edit, distribute, display, perform, create derivative works based upon, or otherwise exploit and/or use their Entry and all elements embodied therein, along with entrant’s name, biographical information, likeness, performance, voice or image, in whole or in part, on their own or together with other materials for advertising, trade, promotional and other purposes, in all media now known or hereafter discovered, in any manner, worldwide in perpetuity, without further compensation, notification or permission. Sponsor has no obligation to make use of the rights granted herein. Released Parties (as defined below) are not responsible for any unauthorized use of Entries by third parties.

WINNER DETERMINATION:  Following the conclusion of the Contest Period, a qualified panel of judges selected by Sponsor will judge all eligible Entries received based on the following equally weighted criteria: (i) why you think you think you deserve to win this opportunity, (ii) why you think now is the right time for you to propose to your Significant Other, (iii) your level of interest in Ben Rector’s music and (iii) the persuasiveness of the Entry (collectively, the “Criteria”).  The Entry that receives the highest score from the judges will be deemed the potential winner. In the event of a tie, a tie-breaker judge will re-judge the tied Entries using the Criteria to determine the potential winner.  Sponsor reserves the right to not award the prize if, in its sole discretion, it does not receive a sufficient number of eligible and qualified Entries.  All decisions of the Sponsor and judges are final and binding.  Sponsor will not reveal the judging scores for any Entry.

WINNER NOTIFICATION:  The potential winner will be notified by phone and/or email and will be required to execute and return an affidavit of eligibility, a liability release, a W-9 form, and, where lawful, a publicity release within the time period specified by Sponsor in such prize notification.  Potential winner’s Significant Other will also be required to sign and return a liability and publicity release.  If all such documents are not returned within the specified time period (if applicable), the prize notification is returned as undeliverable, the potential winner is not in compliance with these Official Rules, or the potential winner and/or their Significant Other does/do not agree to participate in the Proposal (as defined below), the prize will be forfeited and, at Sponsor’s discretion, an alternate potential winner may be selected, time permitting. In addition, Sponsor reserves the right to ask the potential winner and/or their Significant Other to participate in an informal background check process which may take the form of (i) a phone interview with the potential winner and their Significant Other, and/or, (ii) a review of the content posted on the potential winner’s and their Significant Other’s social media network(s) (each such method, a “Background Check”).  Unless prohibited by law, the potential winner and/or their Significant Other shall each grant Sponsor access to their social media networks for purposes of the Background Check.  Potential winner may be disqualified (i) for failure to provide Sponsor with the access necessary to conduct a Background Check as described above (unless prohibited by law) and/or (ii) based on the results of Sponsor’s Background Check, in Sponsor’s sole discretion.  Once eligibility has been confirmed, the potential winner will be deemed the official winner (“Winner”).

PRIZE: One (1) Winner will be awarded a prize package consisting of (collectively, “Prize”): (i) roundtrip transportation for the Winner, Significant Other and up to four (4) of guests (each, an “On-site Guest”) between each such person’s continental US-based home town and New York City; (ii) one (1) night accommodations for six (6) people at a New York City hotel determined by Sponsor (up to three (3) rooms, double occupancy); (iii) admission for six (6) people to a private, exclusive performance by Ben Rector at Radio City Music Hall in New York City on September 20, 2021 (the “Concert”); (v) the opportunity for the Winner to propose to their Significant Other live onstage during the Concert (the “Proposal”); (vi) access for up to twenty (20) of Winner’s invited guests (“Virtual Guests”) to view the Concert and the Proposal virtually via livestream on a platform to be determined by Sponsor (the “Livestream”); and (vii) $5,000 which may be used by Winner towards the costs of wedding jewelry.  Total approximate retail value (“ARV”) of Prize: $10,000 – $18,000.

All travel arrangements will be made through Sponsor.  All travelers must reside within the continental US; travel outside of the continental US will be not be permitted as part of this Contest.  Winner, Significant Other and all On-Site Guests must be able to travel to and stay in NYC during the time period of September 18 – 22, 2021 (dates subject to change).  Transportation method, regardless of type, will be determined by Sponsor in its sole discretion and may include, air, rail and/or other ground transportation.  No compensation or substitution will be provided for difference in values of any transportation method.  Actual value shall be based on fluctuations of actual ground, air or rail costs and the distance between departure city and destination. Winner, Significant Other and all guests who will be onsite at the Concert will be subject to compliance with all COVID-19 related vaccination and/or testing requirements in effect at the time, as determined by Sponsor in its sole discretion, and which may include providing proof of full vaccination.

Prize only includes what is listed in the Prize description.  Prize does not include incidental costs (hotel, travel or otherwise) and/or a ring or other jewelry.  Winner must provide their own ring.  Winner must follow the guidelines for the Proposal that will be provided by Sponsor prior to the date of the Concert and all onsite participants must comply with all venue rules and regulations; failure to do so may result in forfeiture of the Prize (in whole or in part), as determined by Sponsor.  Seat locations will be determined by Sponsor.  Winner, Significant Other and all guests must comply with all venue rules and regulations.  All Virtual Guests must comply with the guidelines presented by Sponsor for the Livestream and may be required to sign a liability and publicity release in order to participate.  Prize is awarded “as is” with no warranty or guarantee, either express or implied.  If Winner and/or Significant Other do not agree or are unable to participate in the Proposal, then Winner forfeits the Prize, and Sponsor reserves the right to award the Prize to an alternate winner, time permitting.  Winner may not substitute, assign or transfer Prize (or any component thereof) or redeem any Prize component for cash, but Sponsor reserves the right, at its sole discretion, to substitute the Prize (or portion thereof) with one of comparable or greater value. Winner is responsible for all applicable federal, state and local taxes, if any, as well as any other costs and expenses associated with Prize acceptance and use not specified herein as being provided. All Prize details are at Sponsor’s sole discretion. If the Concert cannot take place for any reason, Sponsor reserves the right to (i) cancel the Concert and travel portions of the Prize, (ii) to award an alternate prize in lieu thereof, and (iii) if cancelled for public health reasons (COVID-19 or otherwise), to require the Concert and/or Proposal be conducted via a virtual platform (the details for which, if applicable, shall be determined by Sponsor).  In such an event, any difference in actual value will not be awarded.

PUBLICITY GRANT: Except where legally prohibited, by acceptance of the Prize, Winner and their Significant Other grant permission for Sponsor and its designees to use their names, address(es) (city and state), photographs, voices and/or other likenesses (including in the Entry) and Prize information for advertising, trade and promotional purposes, in all media now known or hereafter discovered, in any manner, worldwide in perpetuity, without notice, review, approval or compensation.

The Concert, Proposal and Livestream will be recorded by Sponsor (such footage, collectively, “Proposal Footage”). Winner and their Significant Other and guests understand that Sponsor shall own all right, title and interest in and to the Proposal Footage and that Sponsor and its designees, successors, assigns and licensees shall have the right to edit, modify, reproduce, distribute, display, perform, create screenshots, stills or derivative works based upon, or otherwise exploit the Proposal Footage and all elements embodied therein, along with their names, biographical information, likenesses, performances, voices or images, in whole or in part, on their own or together with other materials for advertising, trade, promotional and other purposes, in all media now known or hereafter discovered (including, without limitation, posting the Proposal Footage on Sponsor’s websites and digital properties (including, without limitation, its social media pages or accounts)), in any manner, worldwide in perpetuity, without further compensation, notification or permission.  Sponsor has no obligation to make use of any of its rights in and to the Proposal Footage. Released Parties are not responsible for any unauthorized use of the Proposal Footage by third parties.

GENERAL CONDITIONS: Sponsor, Ben Rector, JMIC, and each of their respective parents, affiliates, subsidiaries, licensees, sponsors, promotional partners, Prize suppliers, advertising and promotion agencies, and their respective officers, directors, employees, representatives and agents (collectively, “Released Parties”) are not responsible for lost, late, incomplete, inaccurate, stolen, misdirected, undelivered or garbled Entries, email or other communications of any kind; or for lost, interrupted or unavailable network, server, Internet Service Provider (“ISP”), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Contest, including, without limitation, errors or difficulties which may occur in connection with the administration of the Contest, the judging of Entries, the announcement of the Prize, or in any Contest-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest. Released Parties are not responsible for injury or damage to participants’ or to any other person’s computers or other device related to or resulting from participation in this Contest or downloading materials from or use of the related website. Persons who tamper with or abuse any aspect of the Contest or related website, who are in violation of these Official Rules or who act in an unsportsmanlike or disruptive manner, as solely determined by Sponsor, will be disqualified and all associated Entries will be void. Sponsor reserves the right in its sole discretion to suspend, modify or terminate the Contest at any time and for any reason, including, but not limited to, public health (COVID-19 or otherwise), if any portion of the Contest becomes, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of Entries, and, if terminated, in its discretion, to select the potential winner from all eligible, non-suspect Entries received prior to such action being taken or as otherwise deemed fair and appropriate by Sponsor. By participating, entrants agree that the Released Parties will have no liability whatsoever for, and shall be held harmless by entrants against any liability for, any injuries, losses or damages of any kind, including death, to persons or property resulting, in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of the Prize (including any travel or activity related thereto) or participation in this Contest. In the event of a dispute regarding Entries received from multiple users having the same email account, the authorized subscriber of the email account at the time of entry will be deemed to be the entrant and must comply with these Official Rules. “Authorized account subscriber” shall be the natural person who is assigned the email address by the ISP, on-line service provider, or other organization responsible for assigning email addresses. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

DATA COLLECTION/USE: Entrants will automatically be enrolled to receive emails from Sponsor.  Any information provided shall be used by Sponsor in accordance with Sponsor’s Privacy Policy, which can be viewed at https://www.msgentertainment.com/privacy/. Entrants can opt-out of receiving future emails from Sponsor at any time by following the directions provided in any such email.
